Terms and conditions for Instagram competition

The organizer of the competition is Chuango AIoT GmbH, Friesenweg 1, 22763 Hamburg (hereinafter “Chuango”). 

By participating in the competition, the participant accepts the following conditions of participation :

  1. Eligible to participate are persons who are at least 18 years old at the time of participation and who reside in Germany. Excluded from participation are Chuango employees, all persons involved in the creation and implementation of the campaign, and the family members of all aforementioned persons.
  2. The promotion begins on April 26, 2024, and ends on April 28, 2024, at 11:59 PM. Late entries, for whatever reason, will not be considered. Participation in the competition requires participants to complete the following tasks:

  3. There is an Alexa package to be won, consisting of 3 smart Color light bulbs A609C and an EchoDot 3.
  4. On April 29, 2024, the winner will be chosen from the correct answers by drawing lots and notified.

Sequence 

  1. The winner will be notified via direct message on Instagram. The participant agrees that Chuango may send personal messages for the purpose of processing the prize draw.
  2. The winners must respond by email to rebecca@chuango.de within 5 days and provide their address. If a winner does not respond within 5 days, their right to the prize will be forfeited. The prize will also be forfeited if the participant cannot be reached via Instagram Direct Message, if the address provided is incorrect, or if the prize cannot be delivered for other reasons for which the winner is responsible.
  3. Prizes will be awarded via email. Winners must therefore provide Chuango with a valid email address.
  4. Chuango reserves the right to exclude participants from the competition if it determines that they have violated the terms and conditions. Multiple or simultaneous participation by a person in the competition using pseudonyms or through third parties, or any other use of unauthorized means to manipulate the competition, will result in the participant's exclusion. The information required for participation must be truthful. 
  5. The competition may be extended, modified, or terminated prematurely without giving reasons. Chuango assumes no liability for lost chances of winning.
  6. If participation in a competition requires posting comments or images, participants may not include insults, false facts, competition, trademark, or copyright violations, or other illegal content. The participant is liable for any violations.
  7. The participant guarantees that the content submitted by them, especially videos and images, is free of third-party rights and that the content either originates from them or they have obtained the necessary consent from the author and the persons depicted in the images and videos. Furthermore, the submitted content must not contain any insults, false facts, or violations of competition, trademark, or copyright law. The participant is liable for any legal violations.
  8. The participant grants Chuango non-exclusive rights of use to all submitted content, free of charge and without any spatial, content-related, or temporal restrictions. They specifically agree that Chuango may use, distribute, and otherwise make available to third parties the submitted content, in particular the videos and photos and the participant's name, in connection with the campaign and the presentation of the participant contributions and the selected performers, online and offline. This includes, but is not limited to, the publication of the submitted videos and photos on the Internet. For these purposes, Chuango is permitted to edit the uploaded content and, if necessary, to grant third parties rights of use to it.

Privacy Policy 

  1. Participants' personal data, including their name, address, and Instagram user ID, will be stored, processed, and used by Chuango in compliance with the provisions of the German Federal Data Protection Act and solely for the purpose of conducting and administering the competition. By participating in the competition, participants consent to the storage, processing, and use of their data by Chuango. The data will be deleted after the competition has been conducted and processed.
  2. According to the Federal Data Protection Act, participants have the right to free information about their stored data from Chuango, as well as the right to have this data corrected, blocked, or deleted. Participation in the campaign may then no longer be possible.

Final provisions: 

  1. The prize is neither exchangeable nor transferable. Cash payment is excluded, as is legal recourse.
  2. To the extent permitted by law, Chuango assumes no liability for errors or misprints, nor for any damages that may arise in connection with the provision and use of prizes. These limitations of liability do not apply in cases of intent or gross negligence on the part of Chuango, in cases of mandatory statutory liability, or in cases of culpable personal injury. Chuango is not liable for technical or other problems beyond its control.
  3. If Chuango is unable to provide the prize for any reason beyond its control, Chuango reserves the right to provide a replacement of equivalent value.
  4. The law of the Federal Republic of Germany shall apply exclusively.
  5. Chuango may change the terms and conditions of participation at any time without prior notice and without giving reasons.
  6. These terms and conditions, including the competition mechanics, represent the final regulations for the promotion.
  7. Contest participants cannot assert any claims against Instagram related to the contest or participation in it. Participants acknowledge that the contest is not affiliated with Instagram and is not sponsored, supported, or organized by it in any way. All inquiries and information regarding the contest should be directed to Chuango and not to Instagram.
  8. Information on dispute resolution procedures: According to Section 36 of the Consumer Dispute Resolution Act (VSBG), we point out that we are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
